Terms of Service

Notices, complaints and takedown requests go to hey@outbid.eco, which reaches the operator of outbid.eco.

The rules are part of these terms. They set out every amount, every bid step and what may be listed, and where the two documents describe the same thing, the rules are the operative statement of it.

outbid.eco is a paid ranking board. Position is bought. It is not editorial, a review, a measure of quality, or an endorsement of anything listed. Every entry on the board is advertising, and it is labelled as such on the board itself.

Nothing on this site is a recommendation. Rank tells you what somebody paid and nothing whatsoever about whether what they are selling is any good.

A claim buys the position it bought, at the moment it was bought, and a permanent entry on the all-time board recording the amount paid. It does not buy that position for any length of time, and it does not buy exclusivity.

A claim reaches the board when its payment clears. Claims are counted on the all-time board, which never resets, and on the round board, which does.

This is how the board is designed to behave, and it is not a fault, a defect, or a failure to deliver what you paid for:

• Somebody outbids you. Your listing moves down. It is not removed, and your all-time total is untouched. Anyone may do this at any time, including immediately after you pay.
• A round clears. When cumulative donations cross the next milestone the round board resets and a new round opens. The round just ended is archived exactly as it stood. Your all-time rank is not affected by a reset.
• The board changes shape. Categories, pagination, ordering within ties and the presentation of the board may change.

By paying you acknowledge that you know these things happen and that none of them entitles you to a refund. If you want a position to last, the way to do that is to bid again.

Payments are processed by Dodo Payments, whose own terms apply to the payment itself. Bids are quoted before tax. Any tax that applies is added on top at checkout and shown to you there before you pay.

Claims are final and are not refunded. A claim is consumed the instant it is placed: the ranking is delivered immediately and 30% of the amount is committed to a donation at that same moment and reported publicly on the ledger. There is nothing left to return. This includes a claim you regret, a claim outbid minutes later, and a claim placed shortly before a round cleared.

By paying, you ask for the service to be delivered immediately and acknowledge that you lose any right of withdrawal or cooling-off period once it has been. Where a mandatory consumer law gives you a right that these terms cannot remove, that law wins and this paragraph does not apply to it.

Raising a chargeback instead of writing to us is grounds for removal of the listing without refund. If something has gone wrong, email us first and it will be looked at.

30% of the gross amount of each claim is set aside for climate work. The share is calculated and stored on the claim when it is taken, so a later change to the rate does not alter what a past claim committed. Transfers are made periodically and published, with receipts, on the ledger.

This is a commitment about what we do with the money we receive. It does not make your payment a charitable donation by you, it is not tax deductible for you, and it gives you no rights against the receiving organisation. If a recipient organisation becomes unable to accept the funds, an equivalent one will be substituted and the change published on the ledger.

By submitting a listing you confirm that:

• You may list it. You own the destination or are authorised by its owner to promote it here.
• It is lawful. The destination and its contents comply with the law that applies to them, including advertising, consumer and data protection law.
• It is not somebody else's. You are not impersonating another person, brand or company, and you are not using a name or mark you have no right to use.
• It is not malicious. The destination hosts no malware, phishing, or scam, and exists for a real purpose rather than to deceive.
• It is accurate. What you submit is true, and you will keep it so.

What may and may not be listed is set out in the rules. Adult material, chat and invite links, and shortened links are refused there, and that list is part of this agreement.

A listing may be edited, hidden or removed, with or without notice, where it breaches these terms or the rules, where it is unlawful or misleading, where a rights holder or an authority requires it, or where it creates legal or security risk. Removal for breach does not entitle you to a refund, for the reason given above: the donation on every claim is already committed.

If you believe a listing infringes your rights, write to hey@outbid.eco with the listing, what you own, why it infringes, and a statement that your complaint is accurate and made in good faith.

So that a listing can be displayed, you grant a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display the name, icon, description and destination link you submit, for as long as the listing is on the board and afterwards in the archived rounds and the ledger, which are permanent records. You keep everything you owned before, and this licence gives no rights beyond running and describing the board.

The site is provided as it is. It is not warranted to be available, uninterrupted, error-free or secure, and features may change or be withdrawn. Figures on the board, including totals, ranks and donation counters, are provided in good faith but may be delayed or wrong, and are not a statement of account.

If the site is unavailable for a period, that does not extend or refund a claim. A claim buys the position it bought when it bought it, not a duration of visibility.

Nothing here limits liability that cannot lawfully be limited, including for fraud, or for death or personal injury caused by negligence.

Beyond that, the operator is not liable for indirect or consequential loss, for lost profits, revenue, goodwill, traffic, conversions or business opportunity, or for the acts, contents or conduct of any destination listed on the board. Total liability for any claim relating to the service is limited to the amount you paid for the claim the dispute concerns, in the three months before it arose.

You deal with a listed destination at your own risk. The board is not party to anything that happens between you and one of them.

You will indemnify the operator against claims, losses and reasonable legal costs arising from a listing you submitted, from your breach of these terms, or from your infringement of somebody else's rights.

These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Nigeria have exclusive jurisdiction over any dispute arising from them.

If you use the site as a consumer somewhere with mandatory local law that cannot be displaced, that law's protections still apply to you and you may also be able to bring proceedings where you live.

If any part of these terms is unenforceable, the rest continues to apply. Not enforcing something is not a waiver of it. You may not assign your rights under these terms; we may assign ours to whoever takes over running the site.

These terms, the rules and the privacy policy are the whole agreement between us. They may change, and a material change will be posted here with a new effective date before it applies. Continuing to use the site after that is acceptance; a change does not alter the terms a claim already paid was made under.
